Terms of Service

1. Acceptance of terms

By creating an account or using MailZoo, you agree to these Terms of Service. If you do not agree, do not use the service. These terms apply to all users, including free-plan users.

2. Description of service

MailZoo is a software platform that uses artificial intelligence to qualify leads and book appointments on behalf of its users. The service includes AI conversation management across SMS, email, web chat, Facebook Messenger, and Instagram Direct Messages, lead tracking, campaign management, and related features.

3. Your account

• You are responsible for maintaining the security of your account credentials.
• You must be at least 18 years old to use the service.
• You may not share your account with others or create accounts on behalf of third parties without permission.
• You are responsible for all activity that occurs under your account.

4. Acceptable use

You may use MailZoo only for lawful purposes. You agree not to:

• Send spam, unsolicited messages, or messages that violate CAN-SPAM, GDPR, CASL, or any applicable law.
• Import or message contacts without a legitimate basis for contact.
• Use the platform to harass, deceive, or defraud recipients.
• Attempt to reverse-engineer, scrape, or abuse the platform or its APIs.
• Resell or sublicense access to the service.

You are solely responsible for ensuring your outreach complies with all applicable laws in your jurisdiction and in the jurisdictions of your recipients.

When connecting third-party platforms (Facebook Pages, Instagram Business accounts, Twilio, email providers), you must comply with the terms of those platforms in addition to these terms. You may not use MailZoo to violate Meta's Platform Terms, Twilio's Acceptable Use Policy, or any equivalent policy of a connected provider.

5. Billing and payment

• Paid plans are billed monthly in advance. Prices are listed on the pricing page and may change with 30 days' notice.
• Subscriptions renew automatically unless cancelled before the renewal date.
• Refunds are not provided for partial months, but you may cancel at any time and retain access until the end of your billing period.
• Trial accounts include 100 lead conversations over 14 days. Trial accounts are subject to fair use.

6. Intellectual property

MailZoo and its content are owned by us and protected by intellectual property laws. You retain ownership of all data you import into the platform. By using the service, you grant us a limited license to process your data for the purpose of delivering the service.

7. Disclaimers

The service is provided "as is" without warranty of any kind. We do not guarantee that the AI will qualify leads accurately, book a specific number of appointments, or produce any particular business outcome. Results vary by use case, industry, and lead quality.

8. Limitation of liability

To the maximum extent permitted by law, MailZoo shall not be liable for any indirect, incidental, special, or consequential damages, including lost revenue, arising from your use of the service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Termination

We may suspend or terminate your account if you violate these terms, engage in abuse, or fail to pay. You may cancel your account at any time from the Settings page. Upon termination, your data will be retained for 30 days before permanent deletion.

10. Governing law

These terms are governed by the laws of the State of New York, United States, without regard to conflict of law principles.
